Terms of Service
Effective date: February 18, 2026
These Terms of Service ("Terms") govern your access to and use of the FindMePic platform as an Organizer. By creating an account or uploading any content, you agree to be bound by these Terms in their entirety. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
These Terms apply specifically to Organizers (photographers, event hosts, and organisations). Attendee use of the search feature is governed by the consent notice displayed on the search widget.
1. Definitions
- "Service" means the FindMePic platform, including the dashboard, photo upload tools, facial recognition search, and attendee widget.
- "Organizer" / "You" means the individual or entity that has registered an account and uploads event photos.
- "Attendee" means any individual who uses the facial search feature at your event.
- "Biometric Data" means facial feature vectors derived from uploaded photos or attendee selfies.
- "Content" means all photos, metadata, and other materials you upload to the Service.
2. Acceptable Use & Anti-Stalking Policy
You warrant that you have the legal right to capture, upload, and process the biometric data of every individual in your uploaded photos. The following uses are strictly prohibited and will result in immediate account termination and may be reported to law enforcement:
- Indexing faces from public spaces, street photography, or locations where individuals have not consented to biometric processing.
- Scraping or processing images sourced from social media platforms.
- Using hidden cameras, covert recording, or any form of surveillance photography.
- Using the Service to track, identify, or locate a specific individual for stalking or harassment purposes.
- Uploading photos of minors without documented parental or guardian consent.
- Any use that constitutes employee monitoring, time-tracking, or workplace surveillance (see Section 5).
We reserve the right to suspend or terminate your account immediately, without notice, if we have reasonable grounds to believe you are violating this policy, and to report such activity to the relevant law enforcement authorities and data protection supervisory authority.
3. Warrant of Notice to Attendees
You warrant and represent that prior to capturing or uploading any photos, you have:
- Displayed clear, conspicuous physical signage at the event venue entrance informing attendees that facial recognition technology is in use.
- Included a digital notice on any event registration page, ticketing platform, or pre-event communication explaining that photos will be processed using facial recognition.
- Made available a clear and accessible means for attendees to opt out of facial recognition processing before or during the event.
Failure to provide adequate notice may constitute a violation of GDPR, Illinois BIPA, and other applicable privacy laws, for which you bear sole legal responsibility.
4. Data Processing Agreement (DPA)
To the extent that FindMePic processes personal data on your behalf as a Data Processor under GDPR Article 28, the terms of our Data Processing Agreement (DPA), available at findmepic.com/dpa, are incorporated into these Terms by reference and form a binding part of our agreement with you.
As the Data Controller, you are responsible for:
- Ensuring you have a valid legal basis (including explicit consent where required) before uploading biometric data.
- Configuring appropriate data retention periods in your event settings.
- Responding to attendee data subject access requests that you receive directly.
- Ensuring your use of the Service complies with all applicable laws in your jurisdiction.
5. Prohibited Categories of Processing
A. Employee & Workplace Monitoring
This Service is expressly prohibited for use in any employee monitoring, attendance tracking, time-and-motion studies, or workplace surveillance application. Any such use constitutes a material breach of these Terms and will result in immediate account termination.
B. Minors (Under 16)
If your event includes minors under 16 years of age (or the applicable age of digital consent in your jurisdiction), you warrant that you have obtained verified written consent from a parent or legal guardian for the collection and biometric processing of each minor's facial data before uploading any photos in which they appear.
6. Indemnification
You agree to indemnify, defend, and hold harmless FindMePic, its officers, directors, employees, agents, and successors from and against any and all claims, damages, losses, fines, penalties, and legal fees (including reasonable attorneys' fees) arising out of or related to:
- Your failure to obtain the necessary consents, notices, or authorisations from event attendees or other data subjects.
- Your violation of any applicable privacy law, including but not limited to GDPR, UK GDPR, Illinois BIPA, Texas CUBI, or CCPA.
- Any claim by a third party that your uploaded photos violated their privacy, intellectual property, or personality rights.
- Your breach of any representation, warranty, or obligation under these Terms.
- Any wilful misconduct or negligence on your part or that of your employees, agents, or contractors.
This indemnification obligation will survive the termination of your account and these Terms.
7. Limitation of Liability
To the maximum extent permitted by applicable law, FindMePic's total cumulative liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the greater of (a) the total amount you paid FindMePic in the 12 months preceding the claim, or (b) €100.
In no event shall FindMePic be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if advised of the possibility of such damages.
Note: Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
8. Intellectual Property
You retain all intellectual property rights in the photos you upload. By uploading Content to the Service, you grant FindMePic a limited, non-exclusive, royalty-free licence to host, process, and display your Content solely as necessary to provide the Service. We do not acquire any ownership rights in your Content.
You warrant that you own or have the necessary rights, licences, and consents to upload and process all Content you submit, and that doing so does not infringe any third-party intellectual property, privacy, or personality rights.
9. Termination
Either party may terminate the agreement at any time. Upon termination of your account, you may request deletion of all associated data. Termination does not affect any accrued rights or obligations, including your indemnification obligations under Section 6.
FindMePic reserves the right to suspend or terminate your account immediately and without notice for material breach of these Terms, including any prohibited use under Section 2.
10. Governing Law & Disputes
These Terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands, without prejudice to your right to bring proceedings before any competent supervisory authority under applicable data protection law.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Service after that date constitutes your acceptance of the updated Terms.
